1. Service Definition
PlanPass is an AI-powered informational tool that analyzes residential construction documents for potential permit issues. PlanPass provides a preliminary screening of uploaded plans using artificial intelligence.
PlanPass DOES NOT:
- Provide legal, architectural, engineering, or surveying advice
- Guarantee permit approval or compliance
- Replace consultation with licensed professionals
- Constitute a building department review
- Perform any service requiring a California professional license
2. Not Professional Advice
PlanPass does not provide professional engineering, architectural, land surveying, or legal services. The State of California requires such services be performed by licensed professionals pursuant to applicable Business and Professions Code sections.
Reports are generated by artificial intelligence and may contain errors, omissions, or outdated information. All AI-generated content is informational only and must be independently verified.
Users requiring professional advice must consult:
- A licensed architect (California Architects Board)
- A licensed engineer (California Board for Professional Engineers, Land Surveyors, and Geologists)
- Their local building department for jurisdiction-specific requirements
3. AI Accuracy Disclaimer
Reports are generated using AI models that:
- May produce incorrect or incomplete results
- May not reflect recent building code changes or amendments
- Cannot verify information against official government records
- Have no access to jurisdiction-specific permit databases
- Cannot predict building department decisions or outcomes
- May misinterpret uploaded documents
AI-generated content is for informational purposes only and must be independently verified by qualified, licensed professionals before any reliance or decision-making.
4. Limitation of Liability
To the maximum extent permitted by applicable law:
- PlanPass shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the service
- Total aggregate liability shall not exceed the amount paid by the user for the specific report giving rise to the claim
- PlanPass is not responsible for permit denial, construction delays, code violations, inspection failures, fines, penalties, or financial losses of any kind arising from reliance on AI-generated reports
5. User Indemnification
User agrees to indemnify, defend, and hold harmless PlanPass, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- User reliance on AI-generated report content
- User failure to independently verify information with licensed professionals
- User failure to consult licensed professionals before acting on report findings
- User submission of documents they do not have legal rights to upload
- Any violation of these Terms by the user
6. Intellectual Property
By uploading documents to PlanPass, user represents and warrants that:
- User has the legal right to upload such documents
- User grants PlanPass a limited, non-exclusive license to process uploaded documents solely for the purpose of providing the AI-generated analysis service
- PlanPass does not claim ownership of uploaded documents
- Uploaded documents are processed by third-party AI services (Anthropic/Claude) subject to their respective terms of service
7. No Service Guarantee
PlanPass is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee uninterrupted access, error-free operation, or the accuracy of any AI-generated content. We may modify, suspend, or discontinue the service at any time without notice.
8. California Residents
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
California residents have additional rights under the California Consumer Privacy Act (CCPA). See our Privacy Policy for details.
9. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the use of PlanPass shall be resolved by binding arbitration administered in Marin County, California, in accordance with the rules of the American Arbitration Association.
By using PlanPass, you agree to waive any right to participate in a class action lawsuit or class-wide arbitration against PlanPass.
10. Clickwrap Acceptance
By checking both required consent boxes and clicking “I Agree & Analyze,” you acknowledge that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, and the AI Disclosure. This constitutes a legally binding clickwrap agreement. Your acceptance, including the timestamp and terms version, is logged for record-keeping purposes.
11. Assumption of Risk
You expressly acknowledge and assume all risks associated with the use of AI-generated analysis for construction permit preparation. You understand that building codes change frequently, that AI systems may misinterpret construction documents, and that no AI system can guarantee accuracy or completeness. You agree that any reliance on PlanPass reports is at your sole risk.
